Terms of Service

1. Agreement to these terms

These Terms of Service are an agreement between you and Black Cat Baking Company, LLC ("Black Cat Baking Company," "we," or "us"). By placing an order or using this website, you agree to these terms. If you do not agree, please do not use the site.

2. Ordering

You can place an order once the weekly menu is published, which happens every Monday at noon Eastern Time. Each pickup day closes for orders 24 hoursbefore that day opens. After a day's cutoff, we cannot accept new orders or changes for that day. Menu items, prices, and pickup days are set each week and can change from week to week.

3. Payment

Full payment is due at checkout and is processed by Stripe. The total due is shown before you pay. We do not store your card details on our servers.

4. Pickup

All orders are pickup-only at Petal & Crumb, 1 Milford St., Upton, MA 01568, during Petal & Crumb's open hours on the pickup day you choose. We do not ship and we do not deliver.

5. Cancellations, refunds, and missed pickups

You can cancel for a full refund until your order's cutoff. After that, the order is locked in, and a missed pickup is not refunded. See our Refund & Pickup Policy for the full details.

6. Accounts

You can create an account to view your order history. If you do, you are responsible for keeping your sign-in details secure and for activity that happens under your account.

7. Allergens and food safety

Our kitchen handles wheat, gluten, dairy, eggs, tree nuts, peanuts, and sesame. We bake in a shared space and cannot guarantee that any product is free from cross-contact with these allergens. If you have a severe allergy, please do not order.

8. Acceptable use

Please use the site only to place and manage your own orders. Do not try to disrupt the site, access other customers' information, or use it for any unlawful purpose.

9. Intellectual property

The content on this website, including text, photos, and design, belongs to Black Cat Baking Company. Please do not copy or reuse it without our permission.

10. Limitation of liability

To the fullest extent allowed by law, Black Cat Baking Company is not liable for any indirect or consequential damages arising from your use of the site or our products. Our total liability for any order is limited to the amount you paid for that order.

11. Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules.

12. Changes and severability

We may update these terms from time to time. The version posted here is the one in effect. If any part of these terms is found unenforceable, the rest stays in effect.
